ACCEPTANCE OF TERMS By creating an account and using OCTO DATE ("the App"), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use in full. If you do not agree, you must not register or use the App. 2. AGE REQUIREMENT You must be at least 18 years old to use OCTO DATE. By registering, you confirm that you are 18 or older and legally capable of entering into this agreement. 3. NO GUARANTEE OF SAFETY OR OUTCOMES OCTO DATE is a platform that enables users to connect via video chat and messaging. The App does NOT conduct background checks, identity verification (beyond email and phone confirmation), criminal record checks, or character assessments of any user. The App cannot and does not guarantee the safety, honesty, intentions, or behavior of any user. 4. ASSUMPTION OF ALL RISK — FULL USER RESPONSIBILITY You acknowledge and agree that: a. ALL responsibility for any interaction, communication, meeting, or relationship formed through or related to OCTO DATE rests solely and exclusively with you, the user. b. OCTO DATE, its developers, owners, employees, affiliates, and partners are NOT responsible for any damage, harm, loss, or injury of any kind — whether physical, psychological, emotional, financial, reputational, or otherwise — arising from: - Use of the App - Communication with any other user - Any interaction outside the App that originated from or was facilitated by the App - Meetings, dates, or encounters with any user met through the App - Any content shared by users - Any action or inaction by any user of the App c. You use OCTO DATE entirely at your own risk. The App is provided "as is" and "as available" without any warranty of any kind. 5. NO LIABILITY FOR USER CONDUCT OCTO DATE is NOT liable for the conduct, statements, actions, or behavior of any user. The App merely provides a communication platform. All interactions between users are solely between those users, and OCTO DATE bears no responsibility for any outcome resulting from such interactions. 6. USER-TO-USER INTERACTIONS You are solely responsible for: - Your own safety when meeting any other user in person - Verifying the identity and intentions of any user you interact with - Any decisions to share personal information, photos, or location - Any financial transactions with other users (OCTO DATE strongly advises NEVER to send money or financial information to any user) 7. INDEMNIFICATION You agree to indemnify and hold harmless OCTO DATE, its developers, owners, employees, and affiliates from any claim, demand, lawsuit, or liability arising from: - Your use of the App - Your interactions with other users - Your violation of these Terms - Your violation of any law or third-party rights 8. REPORTING VIOLATIONS OCTO DATE provides a reporting system for users to flag violations. Reports will be reviewed, but OCTO DATE is not obligated to take any specific action and is not liable for failing to prevent any user misconduct. 9. NO WARRANTIES OCTO DATE is provided without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. The App does not warrant that the service will be uninterrupted, secure, or error-free. 10. LIMITATION OF LIABILITY To the maximum extent permitted by law, OCTO DATE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the App. 11. MODIFICATIONS OCTO DATE may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms. 12. GOVERNING LAW These Terms are governed by the laws of the jurisdiction in which the App operator is based, without regard to conflict of law principles. 13. NO VIDEO OR AUDIO RECORDING OCTO DATE does NOT record, store, capture, or retain any video chat or audio communication between users. Video chats are conducted in real-time only and are not saved on OCTO DATE servers or infrastructure. However, OCTO DATE cannot prevent users from recording their screen or using external devices to capture video or audio during a call. OCTO DATE is NOT responsible for any recording made by any user during a video chat, and is not liable for any consequences arising from such recordings. You acknowledge that the other user in any video call may record the session using third-party tools, and you accept this risk by using the App. OCTO DATE strongly advises against sharing sensitive or private content during video calls. 14. USER CONDUCT & ACCOUNT TERMINATION The User commits to proper and respectful behavior while using OCTO DATE. OCTO DATE reserves the right to suspend, restrict, or permanently terminate any user's account and activity based on complaints or reports from other users regarding the user's behavior, without prior notice or warning. The user acknowledges and agrees that they shall have no cause of action, claim, or right to compensation, damages, or any other remedy against OCTO DATE, its developers, owners, employees, or affiliates, for any suspension, restriction, or termination of their account or activity in the App, whether partial or complete, temporary or permanent. This clause applies to all forms of account termination, including but not limited to: - Termination based on user reports - Auto-flag triggered termination - Admin-initiated termination - Termination due to violation of these Terms of Use OCTO DATE's decision to terminate any account is final and at its sole discretion. By checking "I have read and agree" and tapping "Accept & Continue", you confirm that you have read, understood, and voluntarily agree to all terms above.
